This Lunch Discussion addressed recent developments in the enforcement of awards against States in the UK and the US.

After a brief introduction by DIS board member Richard Happ, the panelists Evgeniya Rubinina and Carlos Ramos-Mrosovsky discussed issues such as the enforcement into assets of State-owned corporations (as “alter ego” of the State) and peculiar features such as the duty of full and frank disclosure (in the UK) or enforcement asset discovery (in the US). The discussion showed that enforcing awards against States is challenging, but possible, and that a careful selection of the enforcement forum will be of major importance for a successful outcome.
